Terms of Service

These Terms of Service ("Terms") govern your use of the apps, websites, and services provided by Vertex App Studios Inc. ("Vertex," "we," "us," or "our"), including StyleTally and FanCast Arena. By downloading, accessing, or using our products, you agree to these Terms. If you do not agree, please do not use our products.

Service description

Vertex provides consumer mobile applications and related features. StyleTally offers AI-assisted feedback on outfits you choose to upload, along with styling suggestions and a personal looks library. FanCast Arena is a forthcoming companion app for reality TV fans. Features may evolve over time, and we may add, change, or remove functionality to improve our products. Some features are offered free of charge, and others require a paid subscription.

User responsibilities

When using our products, you agree to:

• Use them only for lawful purposes and in line with these Terms.
• Provide accurate information when you contact us or create content.
• Only upload content you have the right to use, and avoid uploading anything unlawful, infringing, or that contains others' personal information without consent.
• Not attempt to disrupt, reverse engineer, or misuse the service or interfere with other users' use of it.

You are responsible for the security of your device and the accounts you use to access our products.

Subscription terms

Some features require a paid subscription. Subscriptions are sold through Apple In-App Purchase and are billed to your Apple ID. Unless cancelled, subscriptions renew automatically at the end of each billing period, and your Apple ID is charged for renewal. You can view, change, or cancel your subscription at any time in your Apple ID settings; cancellation takes effect at the end of the current billing period. Prices and plans may change, and any changes will apply to future billing periods. Refunds for App Store purchases are handled by Apple in accordance with their policies.

Disclaimers & limitation of liability

Our products are provided on an "as is" and "as available" basis. Feedback, scores, and suggestions generated by our apps — including styling feedback in StyleTally — are provided for informational and entertainment purposes only and reflect automated estimates rather than professional advice. We do not guarantee any particular result.

To the fullest extent permitted by law, Vertex disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Vertex will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of our products. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.

Termination

You may stop using our products at any time. We may suspend or terminate access to our products if you violate these Terms or use the service in a way that could cause harm to other users, third parties, or Vertex. Provisions that by their nature should survive termination — including disclaimers, limitations of liability, and governing law — will continue to apply.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that the courts located in Ontario, Canada will have jurisdiction over any disputes arising from these Terms or your use of our products, subject to any mandatory consumer protections available in your place of residence.
